Discriminação etnico-racial no contexto escolar

Abstract

Tendo em vista as discussões que despontam a respeito da efetiva implementação da Lei 10.639/2003 esse trabalho vem discutir e intentar que as ações de reparação a população negra, estabelecidas nessa Lei, sejam de fato executadas dentro das escolas. Para isso, além da Lei e das parcerias formadas entre órgãos como o MEC/SECADI, discutimos o real resultado dessas iniciativas no processo de implantação da Lei nas escolas. Tendo por objetivo neste ensaio compreender se o que diz a Lei é realmente concretizado nas escolas observando dois casos em especial. A primeira se trata de uma escola particular de grande porte em um bairro de classe media alta em Salvador, que atende a alunos do Ensino Fundamental ao Ensino Médio, a segunda se trata de uma escola pública municipal de médio porte na periferia da cidade, que atende a alunos da Educação Infantil até o Ensino Fundamental I. Observo também quais as formas de implantação dessa Lei pelo Estado e quais as políticas públicas estabelecidas para efetivação da Lei e como ele age diante das escolas que não estão cumprindo tais exigências legais. Os resultados obtidos apontam que após uma década do inicio de sua implementação a Lei infelizmente está inoperante e claramente sendo descumprida por ambas, e para, além disso, embora as escolas observadas tenham sido fiscalizadas e com comprovação da não implementação da Lei nenhuma foi notificada e nem sofreu nenhuma sanção pelo descumprimento da mesma, o que se vê é uma lacuna entre o que o Estado diz que tem que ser feito o que se faz nessas escolas.

ABSTRACT Considering the discussions that emerge regarding the effective implementation of the Law 10.639/2003 this work discuss and intend that the remedial actions to the black population, established in this Act, are actually implemented in schools. To do so, besides the Law and the partnerships formed between organs such as MEC / SECADI, we discuss the actual outcome of these initiatives in the process of implementation of the Law in schools. Having as the purpose in this essay to understand if what the law says is actually implemented in schools observing two cases in particular. First, a private school in a large upper middle class neighborhood in Salvador, which serves from elementary students to high school; second, a medium-sized city public school in the outskirts of the city, for students from childhood education to elementary school I. I also observe which are the forms of implementation of this Act by the State and which are the public policies established for the execution of the Law and how it acts on the schools that are not meeting the requirements of Law 10.639/2003. The results indicate that after a decade of this Law implementation, unfortunately, in these two cases the law is inoperative and clearly being breached by both schools, furthermore, any of the schools observed are inspected for evidence of implementation of the Act and they have also not been notified nor suffered any penalty for not executing the Law, what you see is a gap between what the State says it has to be done and what these schools are doing.
